What is a Trademark?

Trademarks provide creators with exclusive brand rights for 10 years, and can be renewed indefinitely. Registering your trademark stops others from using it or similar marks on similar or identical goods or services without permission, benefiting you and giving you control over your unique brand.

A Trademark is a special sign that helps people recognize and distinguish one product or service from another. It can take the form of a word, phrase, symbol, logo, sound, shape, fragrance, color, shade or a combination of these elements that craft a distinguishing identity.

Applications in Dubai are handled by two entities: Ministry of Economy (MoEc) through the Trademark Portal or the Department of Economic Development (DED) through the IP Gateway. Trademarks in Dubai are covered under the Federal Decree by Law No. (36) of 2021 Concerning Trademarks, and the Cabinet Resolution No. 57 of 2022 concerning that same federal decree. Keep in mind that applying through the MoEc will give you protection in the UAE only. If you wish to be protected in other countries or regions, you will need to apply through their IP offices.

To apply for a Trademark, you must be a UAE citizen or have residency status in the UAE. If you are applying from outside the UAE, a local IP Attorney may apply on your behalf.

Before applying for a Trademark, you can use the TM symbol to inform others that you own the mark and are looking to register it. Once it has been registered you can use the ® symbol.

Do this by making sure you have the right agreements in place to protect it from getting out to the public, as failing to do so may lead to your application getting rejected.
